When considering where you want to live or where you want to establish your business, you must understand the constraints that a parcel of real property has attached to it.  The utilization of property is governed by a number of ways, all of which can greatly hinder the utilization of land.  While these constraints offer certain prtections to property owners, communities and commerce, they also create restrictions.  Examples of restraints include:
  • Police Powers- Such items as zoning or specific land uses are boundries that limit use of real property.  Examples could be zoning for certain types of housing, certain size of lots, certain areas for commercial property.
  • Home Owner's Associations- HOAs are entities that regulate construction and activity within a certain area of participating homes.  While the powers held by these entities do not carry criminal weight, they certainly bring authority that is recognized in civil courts.
  • Deed Restrictions- One of the most overlooked areas of property regulation lies in deed restrictions.  These restrictions are certain parameters, attached to the deed or ownership or parcels of real property, intended to create restrictions on use and activities.  In example, property can be deed restricted to prohibit chicken farms, mobile homes or the operation of commercial enterprise.  This can be the most restrictive and hardest constraint to remove from a property.
